Welcome to Fetch Quest AR ("Fetch Quest AR", "we", "us" or "our"). These Terms & Conditions ("Terms") govern your access to and use of the Fetch Quest AR mobile application, the website at fetchquestar.com and any related services (together, the "Service"). By downloading, accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
⚠️ Your Safety Comes First — Please Read
Fetch Quest AR is an augmented-reality game played in the real world, while you are out and about with your dog. Augmented reality overlays game elements on your camera view, but it does not remove real-world hazards. Your safety, the safety of those around you, and the welfare of your dog are always more important than the game.
While playing, you agree to:
- Stay aware of your surroundings at all times. Do not stare at your screen while walking. Look up frequently, and stop walking before interacting with the game.
- Watch for traffic. Never play while crossing roads, near railways, water, cliffs, construction sites or any other hazard. Obey all traffic signals and road rules.
- Keep your dog safe and under control. Follow local leash laws, keep your dog hydrated, and never let the game distract you from your dog's wellbeing, behaviour or health.
- Respect property and the law. Do not trespass on private property, enter restricted or dangerous areas, or break any local laws to reach in-game content. No collectible is worth it.
- Mind the weather and terrain. Dress appropriately, avoid extreme heat or cold (which can be especially dangerous for dogs), and take care on uneven, slippery or unfamiliar ground.
- Be considerate of others. Respect other people, pets, wildlife and the environment. Do not play in a way that endangers or disturbs anyone.
- Do not play while driving or operating any vehicle or machinery.
- Take breaks. Rest when you or your dog are tired. Stop immediately if you feel unwell.
The Service is not a substitute for your own good judgement. You are responsible for your own safety and that of your dog and those around you. If something in the game would require you to do something unsafe or unlawful, do not do it.
1. Eligibility & children
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. Players under the age of 18 should only play with the permission and supervision of a parent or guardian. The Service is not intended to be used by young children unsupervised. Parents and guardians are responsible for supervising minors and ensuring they play safely.
2. Your account
Some features may require you to create an account. You are responsible for keeping your login details secure and for all activity that happens under your account. Please provide accurate information and let us know promptly if you believe your account has been compromised.
3. Licence to use the Service
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Service for your own non-commercial enjoyment. You may not copy, modify, distribute, sell, reverse-engineer or create derivative works from any part of the Service except as permitted by law.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful or fraudulent purpose;
- Cheat, use unauthorised third-party software, bots, or attempt to spoof your location or otherwise manipulate gameplay;
- Harass, threaten or harm other players, or post content that is abusive, obscene, hateful or infringing;
- Interfere with, disrupt or attempt to gain unauthorised access to the Service or its systems;
- Trespass, create a nuisance, or otherwise put yourself or others at risk in order to play.
5. User content & community
The Service may let you share photos, messages and other content with the community. You retain ownership of content you create, but you grant us a worldwide, royalty-free licence to host, display and use that content to operate and promote the Service. You are responsible for the content you share and must have the rights to share it. We may remove content or suspend accounts that breach these Terms.
6. Virtual items & purchases
The Service may offer virtual items, currencies, gear or rewards. These have no real-world monetary value, cannot be exchanged for cash, and are licensed, not sold, to you. We may manage, change or remove virtual items at any time. Any purchases are subject to the rules of the applicable app store and our refund practices and applicable law.
7. Intellectual property
The Service, including its name, logo, graphics, characters, software and content, is owned by Fetch Quest AR or its licensors and is protected by intellectual-property laws. Nothing in these Terms transfers any such rights to you.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free or completely secure. You use the Service, and play in the real world, at your own risk.
9. Limitation of liability
To the fullest extent permitted by law, Fetch Quest AR and its team will not be liable for any indirect, incidental, special or consequential damages, or for any loss or injury arising from your use of the Service, including any real-world activity undertaken while playing. Nothing in these Terms excludes liability that cannot lawfully be excluded.
10. Indemnity
You agree to indemnify and hold harmless Fetch Quest AR from any claims, damages or expenses arising out of your misuse of the Service or breach of these Terms.
11. Changes to the Service & Terms
We may update, suspend or discontinue any part of the Service, and we may revise these Terms from time to time. If we make material changes we will take reasonable steps to notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
12. Termination
We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that could cause harm. You may stop using the Service at any time.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Fetch Quest AR operates, without regard to conflict-of-law principles. This is a placeholder — please replace with your specific governing law and jurisdiction before launch.
